Simanullang, a 52-year-old incense farmer in North Sumatra, Indonesia, demonstrated how the shape of the dried frankincense sap was elongated and thin.<\/p><p>\u201cIn the past, the incense sap from here was on average the size of a fist,\u201d Simanullang, who lives in the Pargamanan-Bintang Maria hamlet in the Parlilitan district, told Al Jazeera. \u201cWhen it was dry it could be used as a foothold to climb and get the incense sap from above.\u201d<\/p><p>Simanullang recalls how residents in the 1990s enjoyed abundant income from high-quality incense \u2013 enough for families to send their children to university.<\/p><p>That changed, residents say, when PT Toba Pulp Lestari (TPL) \u2013 formerly PT Inti Indorayon Utama, one of the largest pulp and rayon-producing companies in Indonesia \u2014 obtained a concession permit from the Indonesian government, and gradually began planting eucalyptus for pulpwood upstream, including on traditional community land.<\/p><p>\u201cThe frankincense trees that grow there have been completely cut down and now eucalyptus is planted. We are very surprised,\u201d another villager, Amir Joel Simbolon, told Al Jazeera.<\/p><p>KSPPM, an Indonesian NGO that represents local communities in North Sumatra, argues that the concession is illegal and in violation of Indonesia\u2019s constitution, which recognises local communities\u2019 customary land rights. Despite this, residents\u2019 attempts to use legal means to regain their land, or receive compensation for lost income, have been unsuccessful.<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-868353840961\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>Eucalyptus from here and across Sumatra is sent to TPL\u2019s factory near Lake Toba, which produces dissolving wood pulp (DWP), a key material in the production of viscose, which is turned into rayon fibre. TPL is owned by Royal Golden Eagle (RGE), an Indonesian conglomerate founded by one of Asia\u2019s richest men, Sukanto Tanoto. Since the 1990s, there have been numerous allegations of illegal land seizures, deforestation and other human rights abuses linked to TPL and another RGE paper pulp subsidiary, APRIL, based in neighbouring Riau province. RGE operates all of the leading factories in Indonesia that produce DWP for export, according to experts and official trade figures.<\/p><p>According to the Indonesian environmental non-profit WALHI, APRIL\u2019s concessions overlap with local or Indigenous community land in at least 114 places.<\/p><p>Meanwhile, TPL alone has encroached on at least 25,000 hectares (62,000 acres) of Indigenous and community forest, with devastating effects on those communities, according to KSPPM and AMAN Tano Batak, another Indonesian NGO. They have also identified dozens of Indigenous peoples around TPL\u2019s concession area who are still struggling to get recognition from the government for their customary forest ownership status.<\/p><p>In many cases, the land was taken without the consent of Indigenous communities, as in the case of Pargamanan-Bintang Maria. Those communities that stand up to companies often face repercussions from the police, according to Tongam Panggabean, the director of BAKUMSU, an Indonesian legal aid non-profit focused on social and ecological justice.<\/p><p>\u201cThere is a threat of criminalisation against people who struggle to defend their land against these claims,\u201d Tongam told Al Jazeera.<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-418790810966\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>After cotton and plastic-based fibres like polyester, plant-based rayon is the third-most widely used material, taking up 5-6 percent of the global market. The non-profit says its efforts have produced a remarkable change in supply chains, with 53 percent of global viscose production now classified as green.<\/p><p>However, this shift has not affected RGE, and TPL and APRIL remain among the producers of DWP globally with the highest deforestation risk. The reason? Many companies in China, Indonesia\u2019s largest trading partner and the world\u2019s largest producer of rayon, have no such sustainability requirements, according to Matt Zimmer, director of governance research at Newday Impact Investing, focused on Chinese supply chains.<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-499198435881\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>\u201cChina has lagged on transparency around ethical sourcing because the requirements of such standards would be in conflict with the state\u2019s goal of increasing its control over business and society,\u201d Zimmer told Al Jazeera.<\/p><p>According to their 2021 report, TPL exported 33,339 tonnes of DWP in 2021, up nearly 50 percent from the 2020 figure of 21,452 tonnes. APRIL does not separate DWP from other forms of paper pulp it produces, but, with a much larger facility than TPL, likely exports even more.<\/p><p>Indonesia exported 1.124 million tonnes of DWP, or more than 99 percent of the total, to China in 2021, according to data from the World Bank\u2019s Comtrade. The official figures may be an undercount, according to analysts such as Murphy, since DWP imported by other companies such as Sateri could be routed via Chinese intermediaries to Xinjiang factories run by Zhongtai.<\/p><p>\u201cSupply chains in China are fairly obscure,\u201d Murphy said. \u201cIt\u2019s difficult or impossible to know how things move within China.\u201d<\/p><p>In 2021, an investigation report in the South China Morning Post identified several Finnish companies as the main exporters of DWP to Xinjiang. Over the past decade, there has been a concerted effort to industrialise Xinjiang, and the region is playing an ever-increasing role in the global viscose market, as companies like Zhongtai open new facilities, often in partnership with other Chinese companies. For example, Zhongtai opened a factory with Zhejiang-based Haihong Textile Printing and Dyeing Co Ltd in 2020, which on its website claims to export fabric, including viscose, to the US, Canada, England, Germany, France, Spain, Japan and South Korea.<\/p><p>\u201cAny manufacturing presence in the region is a risk indicator for forced labour,\u201d Nicole Mogret, a human rights analyst at C4ADS, a US-based think tank, told Al Jazeera. \u201cIn particular, textiles, including viscose, have been identified as sectors that have strong evidence that forced labour is taking place in them.\u201d<\/p><p>Zhongtai has no transparency sourcing policy, and Canopy ranks it near the bottom for sustainability, with a \u201cRed Shirt\u201d rating. Meanwhile, both TPL and APRIL are looking to expand. APRIL alone plans to open new mills that could result in deforestation rising by 120,000 hectares (296,500 acres) of natural forests every year, according to the Eyes on the Forest coalition of Indonesian environmental groups.<\/p><p>\u201cThese companies established their business based on large scale deforestation and land grabbing, and left a trail of a lot of destroyed land and social conflicts,\u201d Sergio Baffoni, a campaigner at the Environmental Paper Network who focuses on Indonesia, told Al Jazeera.<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-660105742684\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>A spokesperson for TPL said the company has not sold DWP to Xinjiang and that it operates on \u201clegal, licenced concession areas and in accordance with all Indonesian relevant laws and regulations.\u201d<\/p><p>In a statement, TPL said: \u201cWe continue to be firmly committed to the implementation of our Sustainability Policy, which, among other commitments, requires that we respect the rights of local communities and indigenous peoples, in accordance with national and local laws and regulations, international best practice, and the principles of Free, Prior and Informed Consent (FPIC).<\/p><p>Our Grievance Mechanism is publicly available and we actively address claims or allegations presented to us in a fair and transparent manner.<\/p><p>Stakeholders and media that are knowledgeable about Indonesia would acknowledge that overlapping land claims is not uncommon in the country and it affects all land-based sectors \u2013 forestry, agriculture, mining, etc.<\/p><p>Cases could be between two or even multiple companies that have been granted overlapping concessions, and also between companies and communities, individuals and indigenous groups that have their respective bases for claiming rights to the land.\u201d<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-854593878499\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>TPL also said that the case of the Pargamanan Bintang Maria community would be a \u201cgood illustration\u201d of how common overlapping claims are if it the situation was more accurately reported.<\/p><p>\u201cTPL has been engaged with the PBM community since 2016 from when the community representatives filed a claim with the Indonesian Ministry of Environment and Forestry (MoEF),\u201d the company said.<\/p><p>\u201cIn May 2018, the PKTHA (Directorate of Land Tenure Conflict Resolution &amp; Indigenous Forest) \u2013 a government agency under the MoEF that mediates on land claims \u2013 reviewed the claim and ruled that the area was in fact classified as a State Forest located in TPL\u2019s concession.<\/p><p>Despite this ruling, TPL as part of its community development program entered into a partnership with the community to support livelihood development and other needs, and this has been ongoing successfully for three years now.\u201d<\/p><p>TPL added that a government review of land claims in the company\u2019s concessions concluded that there were \u201c10 community claims overlapping with TPL\u2019s licensed area and instructed TPL to proactively work with the community groups to resolve these claims.\u201d<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-857541901837\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>\u201cThis has resulted in a partnership program called the Forest Farmers Group, with all 10 claims amicably resolved,\u201d the company said.<\/p><p>APRIL said it does not sell DWP to any companies in Xinjiang and its sole Chinese customer is Sateri, and that it is committed to ensuring there is no deforestation in its supply chain.<\/p><p>In a statement, APRIL said: \u201cAPRIL is subject to annual independent third-party audit of adherence to these commitments, and those audits have not found any instances of a breach of our policies regarding deforestation. The audit reports are publicly available on our website.<\/p><p>APRIL fibre suppliers are also subject to strict due diligence standards, regular compliance monitoring and annual third-party audit. The list of our suppliers and maps of our land concession are publicly available on APRIL\u2019s Sustainability Dashboard.<\/p><p>The quote carried in the article from a Canopy spokesperson that \u2018there is active deforestation and significant community conflicts\u2019 in our operations is false and Canopy has repeatedly been provided with evidence that this is untrue in the past. These include our 1-for-1 pledge to conserve a hectare of forest for every hectare of our plantations, resulting to date in more than 380,000 hectares of conservation and restoration areas under APRIL\u2019s management.\u201d<\/p><p>APRIL said it is also investing up to $15m annually in conservation and is aiming to achieve net zero carbon emissions from land use and net zero loss of protected areas under its 2030 sustainability targets.<\/p><p>\u201cThe company has adopted a target of a 50 percent gain in fibre plantation productivity by 2030,\u201d the company said.<\/p><p>\u201cOver the past three years, we have gained more productivity from the same land bank, posting a 29 percent increase in fibre yield. As a result of our commitment to R&amp;D, more than 60 percent of our total plantation base is now on the higher end of our productivity range. In comparison, improvements in our production processes have reduced fibre required per pulp production ton by up to 10 percent. You can\u2019t really divide Xinjiang and China.\u201d<\/p><p>Similarly, Murphy is concerned that global brands are not yet doing enough to monitor the viscose supply chain.<\/p><p>\u201cWe\u2019ve identified hundreds of fibre manufacturers in the Uighur region, and we see that many of those companies are global suppliers,\u201d Murphy said. \u201cAnd so there\u2019s no question that the enormous amount of fabrics that are being made in the Uighur region are making it into the world.\u201d<\/p><p>One thing appears certain \u2013 China, with 66 percent of global viscose production, is likely to continue to arouse concerns about its supply chains.<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div class=\"ads__slot\"><div><div id=\"div-gpt-ad-673101798113\" class=\"freestar-ads\">\u00a0<\/div><\/div><\/div><\/div><\/div><p>Viscose producers outside of Xinjiang, including Sateri, part of Royal Golden Eagle, Tangshan, Yibin Grace and Xiangsheng Group, are regularly exporting goods to the US and Europe, mostly to wholesalers.<\/p><p>There is another way that Xinjiang viscose might be reaching global supply chains \u2013 via third countries. The top three destinations for Xinjiang viscose are India, Turkey, and Brazil. All three have large garment industries, and Murphy and Mogret believe there is a significant risk that they may be taking Xinjiang fibres and turning them into textile or apparel products for global consumption.<\/p><p>From those countries, it is possible that Xinjiang viscose is then going to the US and other Western countries that have sanctioned and censured Beijing over its policies in the region. There have been more than 5,000 shipments, including viscose or rayon from India, Turkey and Brazil to the US, since 2015, with receiving companies in recent months including Ikea, H&amp;M, Hugo Boss and Asos, according to data from Panjiva.<\/p><p>Murphy believes the current measures being taken by these brands are not enough to ensure they are not using Xinjiang viscose in their products.<\/p><p>\u201cInternational brands are relying on companies that are either Chinese suppliers themselves or companies that are very much reliant on Chinese companies, to tell the truth about where they\u2019re sourcing and whether any of it comes from the Uighur region,\u201d Murphy said.<\/p><div class=\"container--ads in-article-ads\"><div class=\"ads\"><div
